Are towing companies liable for damage?

Tow companies can be held liable for damages in certain situations.  Liability typically depends on the circumstances surrounding the towing process and any damage that may occur to the vehicle being towed.  


Negligence: 

If a towing company is negligent in their actions and causes damage to a vehicle, they may be held liable for those damages.  This could include improper towing methods, failure to secure the vehicle properly, or other negligent actions.


Reason for the tow:

The reason a tow is needed can play a critical part in determining liability.  Additional damage to a vehicle might be unpreventable in recovering a vehicle that was in an accident, went off road, or a variety of other situations.  In a situation where additional damage is inevitable, it is considered a continuation of an accident.  


Documentation:

Both the towing company and the vehicle owner should document the condition of the vehicle before and after the towing process.  This documentation can be crucial in determining liability of damages.
